LINEAGE UK ANNOUNCES SUPPORT OF CHARITY MEALS & MORE

Claire Walters, Regional Vice President of Lineage UK, is proud to announce its support of national charity Meals & More. Since leading foodservice provider Brakes founded Meals & More in 2015, the charity has supported more than 2 million meals at holiday clubs across the UK. Thousands of children and families have benefited from healthy, nutritious food in safe and enriching environments during the school holidays when support for vulnerable children is most needed.

Claire says: “Lineage UK is delighted to be supporting Meals & More. The charity has made amazing strides over the past few years helping reach so many children and young people. Its ethos and mission align closely with our own, in that we wish to transform the world’s food supply to eliminate food waste and feed the world. We are committed to reducing food waste and fighting food insecurity in communities around the globe.”

Peter McGrath, Operations Director at Meals & More, said: “We are delighted that Lineage has joined us on our journey to support children during the holidays. Sadly, the need for support in many communities is growing at a significant rate. The leadership and team at Lineage are clearly very passionate about our cause and their support will assist us in reaching even more children.”

A Meals & More survey conducted in 2023* highlighted that over 70% of parents expected to struggle financially over the summer holiday and, with 1 in 3 children living in poverty, many continue to experience food insecurity and the challenge to help continues to grow.

DEFRA UPDATES ON EXTENDED PRODUCER RESPONSIBILITY FOR PACKAGING (PEPR)

On Wednesday 1 May 2024, the Draft Producer Responsibility Obligations (Packaging and Packaging Waste) Regulations 2024 were sent to the European Union (EU) in respect of Northern Ireland under the Windsor Framework, and their labelling requirements were notified to the World Trade Organisation (WTO), thereby meeting the UK’s obligations as a member.

This notification and the publication of the Regulations provides further clarity to the entire packaging value chain, across the four nations, as we prepare for the introduction of packaging EPR early next year, together.

The full draft Regulations are available for stakeholders to view here.

Timelines

Following agreed notification periods at the WTO and the EU, packaging EPR legislation will be brought before the UK Parliament later this year, with the aim of it coming into force across the UK by the 1 January 2025. Producers are required to report the amount of packaging they place on the market, for the period January to December 24. This reporting will be used to charge producer fees and pay local authorities (LA) for managing packaging waste for the period, April 25-March 26.

Changes to the draft Regulations

Several significant changes driven by stakeholder feedback have been made to the draft Regulations, following feedback from across the value chain, to the packaging EPR consultation. These changes include:

  • The addition of recycling targets for 2025-2030.
  • Introducing a provision which ensures that if a Deposit Return Scheme (DRS) has not been established by 01 January 2028, producers of drinks containers made of PET plastic, aluminium and steel will be subject to the full range of Extended Producer Responsibility for packaging (pEPR) obligations until a DRS is operational for this material.
  • Amending the labelling provisions so that all labelling obligations will now come in to force on the 1 April 2027.
  • The removal of provisions on binned waste and litter payments which will now be delivered through a separate regulation.
  • The Scheme Administrator (SA) must now provide guidance on the methodology used and factors considered in assessing net efficient disposal costs and effectiveness.
  • Revising the household packaging definition to widen the criteria which allows packaging to become exempt from being classified as household packaging, and therefore exempt from disposal cost fees. This definition mirrors the definitions in the relevant data reporting regulations in each nation.

Further detail on these changes, and other key changes made to the Regulations can be found here.

Engagement

A stakeholder webinar on the changes made to the draft Regulations and the next steps following notification, will be held on Thursday 9 May 2024 between 11:00am – 12:30pm. Please register for the webinar here, where you will be able to ask questions directly to Defra policy experts. The period between notification and the webinar will ensure stakeholders have an opportunity to absorb the legislation in full and ask any question they have that may follow, providing further clarity for business across all four nations.

Reporting packaging data

The next major milestone is 31 May: By this point, if packaging producers have not reported their data, they may face enforcement action. Packaging data for all of 2023 is due in two reports; each covering half of the year. Further details are available here, and further support is available through a helpdesk with details available here. This data is essential to ensure the fees on which this scheme is based, are accurate.

Illustrative fees publication and call for evidence to be published shortly

To further prepare businesses for the implementation of the packaging EPR scheme and support its delivery, the four UK administrations intend to release a call for evidence, to support finalising our approach to modulation. This follows extensive engagement with the whole value chain, including industry, Local Authorities, eNGOs and consumer groups. As part of this release, Defra intend to

publish a set of illustrative base fees, following industry calls for information on costs at the earliest opportunity. For further information on packaging EPR, please email the packaging inbox.

SUFFOLK COASTAL PORT HEALTH: CRUCIAL MEASURES TO SECURE BUSINESS AND SUPPLY CHAIN CONTINUITY

Suffolk Coastal Port health have issued the following useful advice for securing your business and ensuring supply chain continuity.

From 00:01 30th April 2024 traders must:

  • Ensure goods arrive through an appropriately designated Border Control Post (BCP) or Control Point (CP) for your commodity type
  • If called, present the consignment for documentary, physical and identification inspections at the BCP or CP

Traders must comply with the requirement to pay any inspection fees and other charges and failure to do so will result in action being taken.  Compliance with the new regime is a legal requirement. The UK government will expect the supply chains of goods subject to Sanitary and Phytosanitary (SPS) controls to be ready for these changes on the 30th April 2024.

Contact points for urgent BTOM queries

From 30th April any urgent BTOM/import queries for plants and plant products across England & Wales should be directed to the Animal & Plant Health Agency (APHA), by email, in the first instance: phsi-importers@apha.gov.uk    Alternatively, you can contact them by telephone: +44 (0) 3000 200 301   From 30th April any urgent BTOM/import queries for animal products should be directed to the Port Health Authority (PHA) at your nominated Border Control Post (BCP).

Find your PHA contact details at your nominated BCP on this map.

Import notifications

The requirement for Common Health Entry Document (CHED) import notifications to be submitted one working day ahead of a consignment’s arrival in GB is an existing requirement for goods from the EU and non-qualifying Northern Ireland goods from the island of Ireland.  Traders are strongly encouraged to submit their CHED import notifications as soon as possible to enable any issues to be resolved prior to their arrival.

From 30th April importers should contact the nominated Port Health Authority (PHA) (or Local Authority (LA) in Scotland), to request a derogation from 24 hours to reduce the import notification window to a minimum of 4 hours if, by exception, they are unable to meet this requirement. Some PHAs/LAs may be able to accommodate a reduction from 24 hours to a minimum of a 4-hour import notification window, but this will be considered on a case-by-case basis for each consignment. For plants and plant products for goods arriving by air and RoRo CHED import notifications should be submitted 4 hours ahead of the goods arrival in GB. All other modes of transport must provide a CHED import notification within one working day.

Getting ready for plant inspections

Places of Destination – an update

The PoD scheme will come to an end on 30th April. On this date, inspections of high-risk plants and plant products will move to designated Border Control Posts (BCPs) or Control Points (CPs). Alongside this medium-risk plants and plant products imported from the EU, Switzerland & Liechtenstein to GB will be subject to documentary and risk-based identity and physical checks at BCPs and CPs from 30th April.

It is important that you look to plan your journeys to BCPs or CPs as early as possible. This will help to reduce any potential delays to your onward journey and ensure compliance with the new UK phytosanitary regime.

Follow these steps and use the resources to help you comply with the new controls and prepare for the changes that are coming for plants and plant products.

Read Defra’s guidance on how to comply with your legal responsibilities for:

If you’re importing fruit and vegetables from the EU to Great Britain, you also need to follow quality and labelling rules.

Checks and inspection rates

Types of checks and an example inspection You can find out more about checks and inspections by watching our recent trader webinar which provided information about different types of checks that can be carried out on consignments at a BCP, talked through an example inspection process and covered what happens after checks have been carried out. Risk categorisation and inspection rates From 30th April 2024, imports are subject to identity checks and physical checks. The percentage of times identity and physical checks will happen (the inspection rate) depends on the risk category of the commodity being imported:

  • high risk commodities are inspected every time the commodity is imported (inspection rate 100%)
  • medium risk commodities are inspected 1-30% of the time the commodity is imported. The specific inspection rate (M1, M2 or M3) depends on the commodity and country
  • low risk commodities are not subject to routine inspection, but may be subject to non-routine or intelligence-led checks

You can now find the inspection rate information for animals and animal products imported from EU and non-EU countries under the BTOM. The risk category summary tables have been updated and now include a column showing the inspection rate that will be applied to that commodity. To find the specific inspection rate for the commodity you are importing please see the ‘inspection rate’ column in the summary tables.

Defra have also now published the risk categorisation spreadsheet for non-EU countries. This spreadsheet can be used to find the risk category for a specific commodity that is being imported from a non-EU country. Search the spreadsheet using a known commodity code, or by browsing the list of commodities.

More information about the frequency of plant health import inspections across GB can be found on the plant health portal

From 30th April, changes to border checks will come into force for high-risk and medium-risk plants and plant products. You can read our guidance to learn more. You can also view Defra’s indicative fees for plant inspections.
