PROGRESS OF THE RETAINED EU LAW BILL THROUGH PARLIAMENT

On 27th January, the House of Lords Library published a research briefing on the Retained EU Law (Revocation and Reform) Bill.

The bill will automatically revoke, or ‘sunset’, most retained EU law at the end of 2023. However, it will also give ministers powers to exempt some retained EU law from the sunset and to restate, reproduce, replace or update retained EU law by statutory instrument.

Concerns have been raised about the amount of retained EU law to be reviewed before the sunset deadline and whether some may end up being revoked inadvertently. MPs and others have also expressed concerns about the impact of large-scale and rapid changes to the statute book because of the bill and have highlighted a lack of clarity about what retained EU law the government intends to keep, particularly in the areas of employment, environmental and consumer protections. They have also been critical of a lack of parliamentary scrutiny of and input into the process of reforming retained EU law. However, the only amendments made to the bill in the House of Commons were government amendments to clarify the bill’s drafting.

The publication of this research briefing came ahead of the bill’s second reading in the House of Lords on 6th February, where members discussed the main issues in the Bill and drew attention to specific areas where they think amendments will be needed.

Employment Relations (Flexible Working) Bill 2022-23 – Update

BFFF has been following the progress of the Employment Relations (Flexible Working) Bill 2022-23. The Bill had its first reading on 15 June 2022 and passed its second reading on 28 October 2022. The Bill completed its committee stage on 7 December 2022 without amendment. In both cases, MPs from all sides of the House spoke in favour of the Bill and no opposition was raised, meaning the stages were passed without division. It is listed for the remaining stages on 24 February 2023.

The Bill would amend the Employment Rights Act 1996 to change the current right to request flexible working in the following ways:

  • Removing the requirement for employees to explain in their applications what effect they think it will have on the employer.
  • Allowing employees to make two flexible working requests per 12 months instead of the one currently allowed.
  • Requiring employers to consult with the employee before being allowed to refuse an application.
  • Reducing the deadline for an employer’s decision on flexible working requests from three months to two months.

We warn our members that not all personal protective equipment (PPE) is the same!

The following article was recently sent out by another trade association.

The British Safety Industry Federation (BSIF) operates a register of suppliers where all members have their products tested to ensure they are up to the relevant standards. Registered Safety Supplier’s products are tested annually as part of the scheme’s audit process and if products fail to meet the test’s strict criteria any issues must be addressed and rectified immediately for members to remain part of the scheme.

Of 387 tests completed on Registered Safety Supplier’s products last year, 332 products (86%) passed immediately and with the 55 (14%) that initially did not meet the test criteria, all issues have now been resolved.

By contrast, the 127 non-member products tested by the BSIF only 18 (15%) were fully compliant with standards and performed as advertised. This means 108 products (85%) failed to meet the regulatory criteria, many of which are still on the market.

Examples of substandard products the BSIF came across for sale in 2022 include:

  • An “indestructible safety trainer” that failed the midsole penetration test.
  • “Cut-resistant gloves” that failed the relevant cut test.
  • A “safety harness and lanyard” provided without any user instructions or documentation.

BSIF chief executive Alan Murray said: “Our latest findings are very concerning and reinforce the importance of only using a BSIF Registered Safety Supplier when procuring PPE and safety equipment.

“The reality is that selling PPE and safety equipment comes with complex responsibilities and it can be hard for even the most diligent suppliers to keep up with the rules and regulations.

CMA ANNOUNCES EXPANSION OF MISLEADING GREEN CLAIMS PROJECT

The Competition and Markets Authority (CMA) have announced they are looking to expand their project looking at misleading ‘green’ claims to now include Fast Moving Consumer Goods (FMCG).

The review will examine the accuracy of environmental claims featuring on a wide range of essential products purchased on a daily basis including food and drink. It will cover both online and in store purchases and take into consideration compliance UK consumer protection law.

Should evidence of unfounded claims be identified, the CMA will consider taking enforcement action using its formal powers.

UPDATED LIST OF UK BCP’S PUBLISHED

Defra and APHA have recently published an updated list of UK border control posts (BCPs) for animal and animal product imports.

Most consignments of animals, animal products and products of non-animal origin from non-EU countries must come through a Border Control Post (BCP), previously known as a Border Inspection Post (BIP).

You must:

  • tell the BCP about your consignment in advance – if you don’t, you may be charged an additional fee or your checks could take longer.
  • make sure the BCP you’re using is designated to check your shipment’s commodity.

You can use the list to check you’re using the right BCP, and to find its contact details.

The list includes:

  • live animal BCPs
  • animal products BCPs
  • products of non-animal origin BCPs

IGD IDENTIFY 6 GLOBAL RETAIL TRENDS FOR 2023

Global insight provider IGD has identified six trends set to influence the global retail landscape in 2023.
