Official HSE guidance to put responsibility of managing risk of drug driving on fleet operators – Let D.tec International help you stay compliant?

Last week, The Health and Safety Executive (HSE) finally published updated guidance on “driving and riding safely for work” to reflect the exponential growth in the largely unregulated “Gig Economy”. The new guidance, written in partnership with the Department for Transport (DfT), aims to clarify where the health and safety responsibility lies for the management of “Work Related Road Risk” and covers everyone driving for work, be it HGV, grey fleet or van drivers.

The guidance has been under review for some time but the dramatic rise in the requirement for “just in time” deliveries appear to have expedited the update.

DfT estimate that a quarter of all road traffic incidents involve someone who is driving for work and workplace fatality statistics provided by The Royal Society for the Prevention of Accidents (ROSPA) confirm that there is a higher chance of being killed at the wheel than being killed whilst on a building site.

As we know, driving under the influence of drugs or alcohol significantly increases the risk and with 74% of substance abusers stating they are in full-time employment, it stands to reason that HSE would align their guidance with the challenges we are facing in society.

For the first time HSE now advise all companies to remind their riders and drivers that they must not drive under the influence of drink or drugs, including prescription drugs.”

This is a huge step in the right direction and fleet operators should not be daunted by this. This change will lead to safer roads for all, and a safer workplace for you and your employees.

Update to the HSE Guidance on the Control of Noise at Work Regulations (L108)

The HSE have now published the update to their guidance on the Control of Noise at work Regulations 2015.

The key changes and updates include;
• An update of references to ISO standards, other guidance and regulations that may have changed since the original version
• A re-arranged structure so that it flows better, including the above chart which explains the regulations and the key elements of the guide related to each
• Some new images on control methods, to reflect up to date workplaces and controls
• improved explanation on how the noise ready reckoner works and the how to use the new noise calculators
• additional information on electronic hearing protection to reflect increasing interest and uptake of these devices
• a new figure outlining how health surveillance should work for those with hearing loss and comments clarifying what HSE expect when employers put health surveillance in place

New Government Plans to Tackle the Lorry Driving Shortage

The government has announced further plans to help reduce the lorry driver shortage.
These plans follow the recently announced vocational test changes which will create an extra 50,000 lorry tests every year. DVSA has already delivered 50% more tests than were available before the pandemic.

Ministry of Defence driving examiners

The Ministry of Defence (MoD) has announced the immediate deployment of their Defence Driving Examiners (DDEs) to work alongside DVSA examiners MoD examiners are fully trained to conduct lorry tests and will work alongside DVSA examiners providing thousands of extra tests over the next 12 weeks. Tests will be added to the booking system and candidates and trainers will be able to book these additional tests. These examiners will be in addition to the 40 extra vocational examiners that DVSA is currently recruiting following a recent recruitment campaign.

Delegated driving examiner changes

The government is bringing in legislation to allow delegated driving examiners at the 3 emergency services and the Ministry of Defence (MoD) to conduct driving tests for one another.
The change will help increase the number of lorry tests that we can carry out and will give the emergency services greater flexibility.
It will also allow NHS Ambulance Services and Foundation Trusts to carry out ambulance driving tests for their own employees.
The change was consulted on over the summer. We will provide further updates on when this legislation comes into force.

Employment opportunities for former lorry drivers

DfT, along with leading logistics organisations have worked with the DVLA to send nearly 1 million letters to thank HGV drivers for their vital role supporting our economy, and to encourage those who have left the industry to return. The letter, which will arrive on doormats over the coming days, sets out the steps the road haulage sector is taking to improve the industry, including increased wages, flexible working and fixed hours. HGV training courses

The Department for Education is investing up to £10m to create new Skills Bootcamps to train up to 3,000 more people to become HGV drivers. The free, short, intensive courses will train drivers to be road ready and gain a Cat C or Cat C&E license, helping to tackle the current HGV driver shortage. An additional 1,000 people are expected to be trained through courses accessed locally and funded by the government’s adult education budget. Fuel tanker drivers need additional safety qualifications, which the Government will work with industry to ensure drivers can access as quickly as possible. To help make sure new drivers can be road ready as quickly as possible, the Department for Transport (DfT) have also agreed to work with Driver and Vehicles Standards Agency (DVSA) to ensure that tests will be available for participants who have completed training courses as soon as possible. An additional 1,000 people are expected to be trained through courses accessed locally and funded by the government’s adult education budget. There are currently 5 Level 2 certificates in driving goods vehicles available to take. Previously, adults who took these qualifications had to pay for their own licences. This change will be backdated and applied to anyone who started one of these qualifications on or after 1 August 2021.

Employers in the industry can also take advantage of an additional £3,000 payment until 30 September for every new apprentice hired.

Seasonal Workers Scheme

5,000 HGV fuel tanker and food lorry drivers will be added to existing visa scheme and will be able to come to the UK for three months in the run-up to Christmas, providing short-term relief for the haulage industry. Recruitment for additional short-term HGV drivers will begin in October and these visas will be valid until 24 December 2021. UK Visas and Immigration (UKVI) are preparing to process the required visa applications, once made, in a timely manner. However, the Government want to see employers make long term investments in the UK domestic workforce instead of relying on labour to build a high-wage, high-skill economy. Visas will not be the long term solution, and reform within the industry is vital. That’s why the Government continues to support the industry in solving this issue through improved testing and hiring, with better pay, working conditions and diversity.

SPECIAL CHEFS AWARDED AT CRAFT GUILD OF CHEFS “RECOGNISING THE CULINARY HEROES” CEREMONY

At a special one-off celebration, the Craft Guild of Chefs will “Recognise the Culinary Heroes” who have gone above and beyond during the pandemic. Forty-four chefs nominated by their peers and colleagues, and selected by a panel of judges, were guests at an exclusive reception and ceremony on Thursday night (23rd September) at the renowned Landing Forty Two at The Leadenhall Building in London.

The Craft Guild of Chefs chose specifically to rename their annual awards for this year, to recognise the work of chefs across the country who have worked tirelessly to put people and their community first. They asked people to nominate chefs who volunteered or refocused their business to support the public or essential workers, or worked with charities and food banks to feed key workers or the vulnerable, those who spearheaded fundraising efforts, and chefs who supported colleagues in overcoming mental health and wellbeing issues.

David Mulcahy, VP Craft Guild of Chefs and co-director of the event, said: “The last year has brought unprecedented challenges and adversity for the entire country. Yet we have seen heroes across the country from all walks of life who exemplify everything that is great and caring about our society, and we’re delighted to honour the chefs among them.”

His fellow co-director of the awards, Steve Munkley VP Craft Guild of Chefs added: “We are increasingly aware of great self-sacrifice and community spirit our chefs have demonstrated. Landing Forty Two is the UK’s highest events space, with stunning views across the Thames and London skyline from 500ft above the City. I can think of no better place to celebrate the heights these chefs have reached in service to the community.”

The winning chefs, who work in many different settings across the industry, were awarded a special badge of recognition and a three-year membership to the Craft Guild of Chefs. The traditional Craft Guild of Chefs Awards will return in June 2022.

WRAP FOOD SYSTEM WEBINARS 6TH AND 7TH OCTOBER 2021

FSA REVEALS STRONG SUPPORT FOR MEAT INSPECTOR CHANGES

The Food Standards Agency (FSA) has revealed that there is strong support for its proposed changes to the way that it plans to modernise the way inspectors carry out ‘official controls’ in meat plants.

Earlier this year, the FSA launched a consultation on the proposed changes called the Future Delivery Model, which ran from May to July 2021. The consultation looked at areas of reform to be phased in over the coming years. The new proposed approach is about using modern ways of working, including technology and intelligence, as well as a more risk-based and proportionate approach.

The FSA also mentioned that there is a need to create more of an onus on industry to enact their primary responsibility for consistently producing food to the required standards, with the FSA as the regulator, monitoring and verifying.

In a report to the FSA board, it highlighted challenges of the changes including the obligations under exports, the regulatory burden on smaller businesses, the ability of small to medium businesses to be able to take advantages of the flexibilities facilitated by modern technology.
