BFFF RESPONDS TO UK DRAFT EPR REGULATIONS CONSULTATION

Members will recall that Defra recently published a consultation on the draft Regulations which will implement Extended Producer Responsibility for packaging, as set out in the March 2022 Government Response. The consultation has now closed but the detail can still be found here.

Many thanks to those of you who shared your thoughts on the proposals. Coupled with outputs from INCPEN trade association group meetings, this allowed us to submit a BFFF response on behalf of the wider membership.

Composite Panels and Electric Vehicle (EV) Charging Point Locations

We are currently seeing EV charging points being mounted on composite insulated panels (CIP’s). In some cases, these panels are highly flammable. In the below example vehicle charging points have been fixed directly to the panels by a competent electrician, you will notice how the steel skin protecting the foam core has been breached with electrical cables through. In addition, the voids have been filled with highly flammable expanding foam. Ignition sources such as the vehicle or charger can ignite the exposed core resulting in rapid fire and smoke spread leading to a risk to life and building/business loss.

We remind our members of the guidance produced by NFUM and other insurers advising that ignition sources must be kept away from CIP’s. Lessons learned from the above is that although your installers are competent in terms of electrical competency in some cases they may not competent in fire safety and CIP’S your risk assessment must be reviewed before any installations are carried out. Martyn’s Law Guidance

Following several terror attacks since 2017 including the Manchester arena, Martyn’s Law will keep people safe, enhancing our national security and reducing the risk to the public from terrorism by protecting public venues including retail and food and drink.

It will place a requirement on those responsible for certain locations to consider the threat from terrorism and implement appropriate and proportionate mitigation measures.

BFFF has booked one of 100 places at a government meeting to understand the detail of Martyn’s Law in 2024, this will provide useful information and support to all business across all sectors for preparing to comply with the legislation and hopefully find out a date for the Bill to be passed.

It is expected that the new legislation will apply to anyone responsible for publicly accessible locations used for purposes such as entertainment and leisure, retail, food and drink, museums and galleries, sports grounds, public areas of local and central Government buildings (e.g., town halls), visitor attractions, temporary events, places of Worship, health, and education. Offices or private dwellings are not included.

The responsibility for implementation is down to the person who controls a premises or event. The Government will use a ‘scrutiny period’ to determine how charities, not-for-profits etc are affected.

The government have indicated that publicly accessible locations with a capacity of more than one hundred people (standard tier) will need to undertake easy and simple activities to meet their obligations. This will include the completion of free training, awareness raising and cascading of information to staff and completion of a preparedness plan.    Those activities will include completing free training, raising awareness and cascading information to staff.

The aim is to ensure staff are better prepared to respond quickly to evolving situations, aware of what processes they should follow, and able to make rapid decisions and carry out actions that will save lives. This could be as simple as locking doors to delay attackers’ progress and access whilst guiding staff and customers to alternative exits. It could also enable lifesaving treatment to be administered by staff whilst awaiting the arrival of emergency services.

Publicly accessible locations with a capacity greater than eight hundred people (enhanced tier) will also be required to produce a risk assessment and security plan, considered to a ‘reasonably practicable’ standard. As well as completing a preparedness plan.

This will allow duty holders to assess the balance of risk reduction against the time, money and effort required to achieve a successful level of security preparedness – plus a recognised standard in other regulatory regimes (including Fire and Health and Safety).

GOVERNMENT PUBLISH POLICIES ON CONSISTENT RECYCLING COLLECTIONS

Government have finally confirmed the long-awaited policies for consistent recycling collections for households and businesses.

Branded as ‘a new, simpler common-sense approach to recycling’, the reforms are said to be more convenient and practical, enabling people across England to recycle the same materials and put an end to confusion over what can and can’t be recycled in different parts of the country.

Weekly collections of food waste will also be introduced for most households across England by 2026. This will also stop a trend towards three- or four-weekly bin collections seen in some local authorities across the UK.

The Government is also proposing new exemptions to make sure that waste collectors will be able to collect dry recyclables together, in the same bin or bag, and collect organic waste together, to reduce the number of bins required.

Timescales:

Households recycling collections: Councils will be legally required to collect all specified packaging materials for recycling by March 2026 except soft plastics which is by 31 March 2027 (or earlier if they are able to do so).

Businesses recycling collections: Businesses will be legally required to collect all specified packaging materials for recycling by March 2025 except soft plastics which is by 31 March 2027 (businesses can be offered recycling collections for materials sooner by their contractors if possible).

Micro-firms recycling collections (defined as those with 10 or fewer employees): Legally required to collect all specific packaging materials for recycling by March 2027 for all materials.

FSA WARN OF LISTERIA MONOCYTOGENES IN IMPORTED ENOKI MUSHROOMS

Following an Rapid Risk Assessment the Food Standards Agency (FSA) and Food Standards Scotland (FSS) have published a news story advising pregnant women and those with a weakened immune system to thoroughly cook Enoki mushrooms before consuming them due to possible presence of Listeria monocytogenes and the risk of severe disease.

In addition to the consumer advice, they’ve also issued a smarter communications letter to Local Authorities and have asked that this letter be shared with members in case you are importing, using, or selling Enoki mushrooms.

SYSCO GB TO OFFER SUSTAINABILITY TRAINING TO ALL 8,000 COLLEAGUES

Sysco GB has embarked on an ambitious plan to offer comprehensive training on sustainability to all colleagues across its British businesses.

The UK’s leading foodservice wholesaler has joined forces with specialist sustainability consultancy, Knowledge Labs from Nutritics, to create and deliver a bespoke training programme that will give Sysco colleagues the knowledge and tools to support customers in becoming more sustainable.

Initially starting with colleagues in commercial roles, the programme, developed following a survey of existing knowledge, is built around eight modules. It covers key sustainability topics including Climate Change; Carbon Footprinting; Operational Sustainability; Healthy and Sustainable Diets; and Food Waste. This will enable colleagues across the business to better understand the importance of sustainability at Sysco and in its customers’ businesses.

With the topic becoming increasingly important to customers, the training will initially be undertaken by frontline sales colleagues, who will join online training sessions delivered by experienced trainers.

In addition, Sysco GB’s 15 development chefs will receive additional face-to-face training to understand the main challenges for a sustainable food system at every stage of the food chain and how to apply that to the latest thinking on plant-forward and healthy, sustainable dishes.

This training aims to transform our sales teams into sustainability champions – supporting our customers to better understand the impact that they can have through their businesses and in particular their menus.
