IMPORTANT UPDATES REGARDING FISH EXPORTS TO CHINA

Defra have issued several important updates from the Chinese customs authority (GACC) regarding fish exports to China. Please see below. Should you have any questions, we would suggest you send them directly to exports@apha.gov.uk to ensure you receive the very latest information.

 

DALIAN

We have been informed that due to an outbreak of COVID-19 in Dalian (which China believes has been transmitted via cold- chain product imports), no further exports will be permitted to enter Dalian for the foreseeable future. As a result, their cold stores have been closed. Therefore, please avoid exporting to Dalian at present.

 

IMMINENT VIRTUAL INSPECTIONS BY GACC – ADDITIONS LIST 

As you are aware, new applications to export to China may result in an inspection request from GACC.

We have recently received information from GACC indicating that two or three sites currently awaiting approval to export to China are likely to be inspected before 1st Jan 2022. This does not include sites currently awaiting relisting audits following COVID-19 outbreaks. We will be in touch directly with any exporters selected by GACC for inspection once they have been identified.

Those subject to virtual inspections should expect it to cover both food hygiene and COVID-19 protocols.

 

ADMINISTRATIVE AMENDMENTS TO LISTINGS

Type: GACC have advised us of an amendment to the way in which the ‘type’ field is submitted:

  • Previously, the optionswere: PP-Processing Plant; FV-Fishing Vessel; Transporting Vessel; FFV- Fishing and Factory Vessel; and CS-Cold Store. If your establishment was registered as both a PP and a CS, this would have been listed as ‘PP & CS’ on the spreadsheet.
  • In future,only one type will be permitted by GACC to be listed. Therefore, if your establishment has both a PP and a CS, this will be listed as just ‘PP’ in future.
  • We have been assured thatyou will still be able to export as a CS providing it shares the same approval number with your PP, it is simply a change in how this information is presented. We have already shared the amended list with GACC for current exporters so please do not be alarmed if you notice a change in type to just ‘PP’.

Processing methods: GACC have also notified us of a minor adjustment to the list of processing methods:

  • Cannedand bottled will now be listed as ‘cooked’.
  • Refining oilwill now be listed as ‘fish oil / shrimp oil’
  • Once again, we have already shared an amendment of the current exporter list with GACC, so you may notice this adjustment in due course.

 

DECREE 248

As you will be aware, Decree 248 will be implemented from 1st January 2022. We are in close contact with the British Embassy in Beijing, and have been advised of the following guidance, but please note that this information may be subject to change as we continue to receive clarification and updates from GACC.

 

LEGAL REPRESENTATIVES

We would like to draw your attention to Article 19, Decree 248:

In cases of changing production site, legal representative, or registration number in the country/region where the manufacturer is located, the overseas (i.e. UK) manufacturer shall re-apply for registration, and the original Chinese registration number will automatically become invalid. 

If the actual owner of the business remains the same, but the management of the production site (factory) of the enterprise is changed, the registered enterprise can apply for information change first, and the GACC will evaluate the corresponding change to see if it has an actual impact on the enterprises food safety and hygiene management and control and decide whether to approve the change. 

If it is assessed that the relevant changes and adjustments may affect the food safety and hygiene management and control of foreign enterprises, GACC will require the enterprises to submit a new registration application. 

After the new registration application is approved, the original Chinese registration number and registration will be invalid automatically.

Our understanding is that:

Legal representation means the owner of the site. Therefore, where a site is bought by another company and has a new owner, the site will automatically need to reapply for approval.

Legal representation does not necessarily mean the site manager. However, where an individual site manager changes, the site should apply to GACC for a change in information and GACC will make a decision on the need to reapply for approval.

If reapproval is needed, the GACC registration number will remain valid until the new approval (and subsequent new GACC registration number) is confirmed. We have had no formal request from GACC to register legal representatives at this time.

We will continue to work with the British Embassy in Beijing to gain additional/ ongoing clarity on the situation for both new and existing exporters. Further updates will be communicated as and when they are received.

 

REGISTRATION PERIODS

All currently registered exporters have been granted a one-year licence ‘extension’ by GACC. Therefore, the earliest expiry of any licence will be 31st December 2022. We will have to see how GACC actually implement this system, but companies will have to apply for re-registration between 3 and 6 months prior to the expiry date.

Please be aware that we are still awaiting further comment from GACC on the proposed new fishery product EHC, therefore the existing EHC remains available and signable.

 

 

 

PLASTIC TAX UPDATE

Last week HMRC ran two webinars outlining further details on the Plastic Tax that comes into force on 1st April 2022. The Tax of £200 per tonne will be applied to most plastic packaging unless it contains 30% recycled content. The first webinar was called “Introduction to Plastic Packaging Tax”, members can access a recording of the webinar by following this link). The second webinar was called “Plastic Packaging Tax -admin and technical aspects”, again members can access a recording by following this link. Members can also access some slides that we have created for our SIG Packaging meeting held on 16.11.21, these summarise the key points from both webinars. There is still more guidance to be published over the coming months as there are still many questions that need to be answered.

What is clear is that many members will find it impossible to use recycled content as the use of mechanically recycled material is not permitted in food contact packaging. Whilst there is now some chemically recycle material, it is very limited volumes and questions remain on how it can be verified. The key strategy should be to reduce the amount of film used.

COVID PROTOCOL AT THE BFFF ANNUAL LUNCHEON

With the Luncheon now less than a week away we would like to advise those members attending of the precautions the Federation has taken to ensure we have a Covid safe event. I have personally attended several events over the last few weeks where I have been surprised by a lack of checks to whether I have a Covid pass or Covid free. This somewhat differs from the Covid safety protocols being followed by BFFF members in their offices, factories, and distribution centres.

Under the guidance of Simon Brentnall, our lead on Health and Safety, we have created what we consider to be a process that will help to create a Covid safe event.

As you will read, we will be checking everyone on arrival, so please ensure you arrive a little earlier than normal and have the required information. Where you have guests attending can you please ensure they are fully aware of the protocol.

We are really looking forward to seeing so many members at the Luncheon and hope this is the first step to returning to normality.

FSA UPDATED RISK MANAGEMENT ADVICE ON ETHYLENE OXIDE CONTAMINATION

Further to previous communications regarding Ethylene oxide (EtO) contamination, the FSA have now issued an update which, in summary, clarifies that their Risk Management Advice (RMA) applies to the known contamination issues and should not be used to retrospectively look at previously manufactured products where there is no evidence of contamination issues.

The latest FSA advice reads as follows:

Following previous discussions and meetings with industry, we have updated our risk management advice to address an issue with misinterpretation of the previous advice. Whilst the advice fundamentally remains the same as we continue to consider further evidence provided by industry, the wording has been amended to emphasise that the RMA applies to the known contamination issues and should not be used to retrospectively look at previously manufactured products where there is no evidence of contamination issues. 

“2-Chloroethanol (2-CE) has been found in varying levels (0.15 mg/kg to 64 mg/kg) within a number of batches of calcium carbonate.  Due to the lack of toxicological data and evidence, it is assumed that 2-CE, as a known breakdown product of Ethylene Oxide (EtO), is also a genotoxic carcinogen.  As an assumed genotoxic carcinogen, no level can be considered to be without risk to health. 

A number of RASFF alerts have been raised by EU Member States where 2-CE has been found in supplements supplied by UK businesses, which has resulted in withdrawals and recalls being issued in these EU Member States.  On the basis of risk assessment and taking account of the large number of products that are manufactured using calcium carbonate, risk management advice for this issue has been developed. 

Food businesses are advised to discontinue using batches of calcium carbonate to manufacture products where levels of 2-CE have been detected.  

Where finished products that have already been placed on the market that have been manufactured with calcium carbonate known to have been contaminated with 2-CE greater than 10 mg/kg (sum EtO and 2-CE), it is advised that they are withdrawn from market.  

Finished Products manufactured with calcium carbonate that is known to have been contaminated containing less than 10 mg/kg sum EtO and 2-CE, can remain on the market.”

COMPANY SHOP’S 15TH STORE ANNOUNCEMENT CEMENTS PERIOD OF SUSTAINED GROWTH AND UNPARALLED SOLUTIONS TO THE INDUSTRY

Company Shop Group, the UK’s largest redistributor of surplus food and household products, has this week announced its latest store opening as part of a period of extensive and rapid growth which has seen the group more than double its capacity in the past two years.

Having already opened four stores in 2021 alone, on top of the five new stores opened in 2020 despite the pandemic, Company Shop has unveiled its latest superstore, set to open in South Yardley on Thursday 2nd December. With this opening, the Group will have increased its collective store square footage by 228% during the past two years.

This takes the total of Company Shop stores to 15 across England and Scotland, alongside a growing 7 Community Shop social supermarket stores, following the opening of its Beechwood store in Wirral in late June. The Group also opened a second distribution centre during this period to enable them to handle increasing volumes of complex surplus goods.

As well as providing 142 new local jobs this year, with an additional 40 roles at the new Midlands site, the Group continues to expand on its unparalleled and sustainable surplus solutions for retailers, manufacturers, and brands across the UK. The Group works at the heart of the supply chain to handle and redistribute almost all of forms of surplus food and products that would otherwise needlessly going to waste. In turn, it generates a significant social, economic and environmental return which is a benefit for businesses, the planet and for communities everywhere.

While world leaders discuss some of the key issues threatening the planet at COP26 this week, Company Shop Group is leading the way in tackling a largely overlooked and underappreciated problem, reflected in the fact that food waste and redistribution did not make it onto the Conference agenda. This is despite the challenge of unnecessary food waste being so vast that if it were a country, it would have the third-biggest carbon footprint after the US and China, according to the UN’s Food and Agriculture Organisation.

Alongside providing sustainable surplus solutions to the industry, the Group’s rapid growth, bolstered by its acquisition by waste management company Biffa plc, has also seen tens of thousands more people across the UK benefit from access to surplus food that could have otherwise gone to landfill, helping to stretch family budgets.

The results of the Group’s expansion speak for themselves. In 2020, the Group redistributed more than 80 million items of surplus food and domestic products, in turn saving 28,073 tonnes of food and household goods from going to waste. This saved the Group’s network of members over £64 million on their food bills. More so, the Group’s latest Sustainability Report revealed the Group paid over £20million back to industry partners for their surplus stock during 2020.
