
New legislation was laid before parliament yesterday 30th November 2020 and comes into force on 2nd December 2020
Firstly, the Health Protection (Coronavirus, Restrictions) (All Tiers) (England) Regulations 2020 (SI. 2020: No. 1374) https://www.legislation.gov.uk/uksi/2020/1374/introduction/made
These regulations replace the current national restrictions and introduce a new ‘tier’ approach in line with the winter plan which we have previously communicated.
Secondly, the Health Protection (Coronavirus Restrictions) (Local Authority Enforcement Powers and Amendment) (England) Regulations 2020. In these regulations designated local authority officers will have powers to enforce material breaches found in relation to Covid.
These regulations provide the power for designated local authority officers to be able to serve:
- Regulation 3: Coronavirus Improvement Notice
- Regulation 4: Coronavirus Immediate Restriction Notice
- Regulation 5: Coronavirus Restriction Notice
When a business has failed to comply with one of the statutory provisions that are set out within Regulation 2 of the Regulations
